During the morning session, the justices reversed a lower court's church-and-state ruling against a church playground in Missouri which was excluded from receiving state funds intended for non-profits. Query whether you, Justice Kennedy, would count as one of those activist judges, having joined the controlling opinion that kept Roe from being overturned in 1992?

The cases include the rights of immigrants to court hearings while they face long periods of detention and the validity of a provision of immigration law that makes deportations easier.

That review should be complete before October 2, the first day the justices could hear arguments in their new term. But the court recessed without any announcement.

Trump has previously said that he was unaware of Kennedy's retirement plans, telling theWashington Times back in May that he didn't want to discuss the rumors.

Kennedy has sat on the court almost 30 years, making him the longest serving of the current justices. Kennedy and his clerks were gathering over the weekend for a reunion that was pushed up a year and helped spark talk he might be leaving the court.

In the biggest dispute before the justices, the court handed a partial win to Trump by partly reviving his travel ban that he has said is needed for security reasons but opponents criticize as discriminatory.

The ban would apply to citizens of Iran, Libya, Somalia, Sudan, Syria and Yemen.

Trump's travel ban has twice been ruled unconstitutional, and the administration has asked the Supreme Court to take up the issue in the next term.

The Supreme Court's current term ends next week and with that ending comes rumors that Justice Anthony Kennedy is planning to retire.

Those rumors have taken on a new intensity in recent months - to the chagrin of liberals concerned that Trump would nominate a far-right justice to replace him.

The point was - and is - this: Whether or not conservatives loved or even liked Trump, he would nominate people to the Supreme Court who were considerably more conservative than the people Hillary Clinton would choose.

On Monday, the justices are expected to decide on a case regarding school vouchers, as well as Trump's 90-day ban of travelers from Muslim countries.
