"We are ready to build a Masjid in the Muslim dominated area of the contested land", Shia Board said in the affidavit.

On March 22, 2016, a Bench led by then Chief Justice of India T.S. Thakur said that Dr. Swamy's plea to "rebuild" the Ram temple would be sent to the appropriate Bench dealing with the Ramjanmabhoomi title dispute appeals.

The matter is pending before the apex court since 2000.

The Uttar Pradesh Shia Central Waqf Board (UPSCWB) said, in the affidavit, that only they are entitled to negotiate and arrive at a peaceful settlement with other remaining stake holders.

On July 27, Shia Waqf Board had claimed to be one of the parties in the case. It said that such a panel would be headed by a retired Supreme Court judge and will have members nominated by the Prime Minister and Uttar Pradesh Chief Minister.

Earlier, the court had said that the Ayodhya dispute is a sensitive and sentimental issue that needs to be settled amicably and through consensus.

The affidavit assumes significance as it has been filed within few days of the Supreme Court agreeing to fast track the hearing on a bunch of appeals challenging the Allahabad High Court verdict on the land dispute in the case. Several meeting of party's minority wing have been held recently in Lucknow and Faizabad, where Sunni Waqf Board and Babri Masjid Action Committee were accused of creating differences between the people.

"Going by this fact it was always a Shia mosque.only the Imam and Muezzins of the mosque were Sunnis who were paid their due by the Shia Mutawwali". All parties can settle this issue by sitting together and the Supreme Court give them time in it. The Board alleges that earlier Shia and Sunni have worked together and had deliberately lost the case.

The BJP leader had said the main appeals against the Allahabad High Court order were pending in the top court since many years and required an urgent hearing.
